The Michigan Dram Shop Act

The Michigan Dram Shop Act (MCL 436.1801) is a powerful law designed to protect the public. It allows individuals injured by a drunk driver to file a lawsuit against a licensed retail establishment if that business unlawfully provided alcohol to the driver.

To win a Dram Shop case, we must prove the establishment broke the law in one of two ways:

  1. Serving a Minor: They sold or furnished alcohol to someone under the legal drinking age of 21.

  2. Serving a "Visibly Intoxicated" Person: They served alcohol to a patron whose impairment was obvious to an ordinary observer.

The Challenge of Proving "Visible Intoxication"

Insurance companies representing bars fight these claims aggressively. They will inevitably argue, "The driver seemed perfectly fine to our bartender."

The Michigan Supreme Court requires plaintiffs to present evidence of actual, visible intoxication at the time of service, rather than relying solely on post-crash blood alcohol tests. We must establish that the patron was exhibiting clear signs of drunkenness, such as:

  • Slurred speech.

  • Stumbling or an unsteady gait.

  • Belligerent, loud, or obnoxious behavior.

Furthermore, the statute of limitations to file a Dram Shop lawsuit is only two years from the date of the injury, compared to the standard three years for a general personal injury claim.

The "Name and Retain" Rule

Another unique hurdle in Michigan is the "name and retain" provision. You cannot simply sue the deep pockets of the bar and ignore the drunk driver. The law requires you to name the intoxicated driver as a defendant in the lawsuit and retain them in the case until the litigation concludes through trial or settlement.
