The No-Fault Maze: Who Pays Your Medical Bills?
If you are injured as a passenger in a rideshare vehicle, your first concern is getting your medical bills paid and covering your lost wages. In Michigan, these are called Personal Injury Protection (PIP) benefits.
You might assume that Uber or Lyft automatically pays these bills. They do not. Under Michigan’s No-Fault order of priority for rideshare passengers, you must seek PIP benefits in this specific order:
Your Own Auto Policy: Even though you were a passenger in someone else's car, your own auto insurance policy is the first in line to pay your PIP benefits.
A Resident Relative’s Policy: If you do not own a car, you must file a claim through the policy of a spouse or relative who lives in your household.
The Rideshare Vehicle's Policy: If you and your household have no auto insurance, then you look to the policy covering the Uber or Lyft vehicle.
The Michigan Assigned Claims Plan (MACP): As a last resort, the state will assign an insurance company to your claim, but your medical benefits will be strictly capped at $250,000.
Warning: You only have exactly ONE YEAR from the date of the crash to file a formal application for No-Fault benefits. If you miss this deadline, you will forever lose any benefits to which you might be entitled.
The $1 Million Safety Net (For Pain and Suffering)
PIP benefits only cover your economic losses (medical bills and wage loss). They do not compensate you for the trauma, physical pain, and scarring you endured. To get that compensation, we file a Third-Party lawsuit against the at-fault driver.
This is where the rideshare company’s commercial policy comes into play.
If the Uber or Lyft driver is actively transporting you (the passenger) when the crash happens, Michigan law requires the rideshare company to provide a $1 million liability insurance policy. This $1 million policy can cover your pain and suffering if the rideshare driver caused the accident.
If the other vehicle caused the crash, we file a claim against that driver's liability policy. However, if that driver is uninsured or underinsured, Uber and Lyft provide up to $1 million in uninsured/underinsured motorist coverage for injured passengers.
The Legal Hurdles You Will Face
Just because there is a $1 million policy available does not mean Uber or Lyft will hand you a check. These are massive corporations with teams of lawyers designed to minimize payouts. They will fight your claim by arguing:
You aren't hurt badly enough: To win a pain and suffering claim in Michigan, we must prove you suffered a "serious impairment of body function".
The other driver was at fault: If there is a dispute over who ran the red light, Uber's insurance will blame the other driver, and the other driver will blame Uber. We have to subpoena the Uber driver's app data and the vehicle's black box to prove the truth.
